The agreement
Creating an account means you accept these terms. If you're signing up for a company, you're accepting on its behalf.
These Terms of Service ("Terms") are a binding agreement between you and Tenantly ("Tenantly", "we", "us") governing your use of tenantly.ca, app.tenantly.ca, and related services (together, the "Service"). By creating an account or using the Service, you accept these Terms and our Privacy Policy.
If you use the Service on behalf of a company or brokerage, you represent that you have authority to bind that organization, and "you" includes it.
What Tenantly is (and isn't)
We're the matching platform, not your broker. We connect you with listings and licensed professionals — we don't negotiate deals, give real estate advice, or take a commission.
Tenantly is a technology platform that aggregates commercial listings, matches them against tenant requirements, and connects tenants with listing brokers. Tenantly:
- Is not a real estate brokerage and does not trade in real estate, represent parties in transactions, or provide real estate, legal, tax, or investment advice;
- Is not a party to any lease or transaction arranged between users. Any deal you make is between you, the other party, and your respective professional advisors;
- Does not take a commission on transactions. Brokers pay a subscription (see Pricing); tenants pay nothing.
Accounts
Give us accurate information, keep your login secure, and one person per account.
You must provide accurate, current information when creating an account and keep it up to date. You are responsible for all activity under your account and for keeping your credentials secure. Accounts are personal — don't share logins or let others act through your account. Notify us promptly at support@tenantly.ca if you suspect unauthorized use.
Tenant terms
Free forever, no exclusivity, no obligation. When you save a listing, its broker sees your requirements — that's how connecting works.
Tenant accounts are free. Using Tenantly does not create an agency relationship, an exclusivity obligation, or any commitment to transact. You may work with any broker you choose, on or off the platform.
When you save or engage with a listing, you consent to the listing broker receiving your mandate details (requirements, budget range, timing) so they can respond, as described in our Privacy Policy. Keep your mandate reasonably accurate — matching only works with real requirements.
Broker terms
Be licensed, follow your regulator's rules, and only sync client data you're allowed to sync.
By creating a broker account, you represent that you are (or act under) a real estate professional licensed in the jurisdictions where you operate, and that your use of the Service complies with the rules of your regulator and any applicable board or association, including advertising and client-consent requirements.
You are responsible for the accuracy of listings and requirements you publish, and for having authority to upload or sync any client data — including data synced from your CRM. Leads generated through the platform are provided for your direct business use, not for resale or redistribution.
Listings and market data
We aggregate from many sources and work hard to keep data fresh, but always verify details before making decisions.
The Service aggregates listing information from brokerages, public sources, and users. While we work to keep the index current and deduplicated, we do not guarantee that any listing is accurate, complete, available, or error-free. Listing content belongs to its originating source. Always verify material details — availability, measurements, pricing, zoning, permitted uses — directly with the listing broker or through your own professionals before relying on them.
Fees and billing
Tenants: $0, forever. Brokers: a subscription billed up front, cancel anytime, effective at the end of your billing period.
Tenant accounts are free of charge. Broker subscriptions are billed in advance on a monthly or annual cycle at the rates shown on our Pricing page, plus applicable taxes. Prices may change with at least 30 days' notice; changes take effect at your next renewal.
You can cancel anytime from your account settings. Cancellation stops future renewals; your subscription stays active until the end of the period you've paid for. Except where required by law, fees already paid are non-refundable.
Acceptable use
Don't scrape, spam, misrepresent, or break things.
You agree not to:
- Scrape, harvest, or bulk-export data from the Service, or access it by automated means except through interfaces we provide;
- Post false, misleading, or infringing listings or requirements;
- Misrepresent your identity, licensing status, or authority;
- Use the Service to send spam or unsolicited commercial messages;
- Probe, disrupt, or circumvent security or access controls;
- Use the Service to build a competing dataset or product.
We may suspend or remove content or accounts that violate these rules.
Intellectual property
The platform is ours. Your data is yours — you give us permission to process it so the service can work.
The Service — including its software, design, and the compiled market index — is owned by Tenantly and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose while your account is in good standing.
You retain ownership of the content and data you submit. You grant us a licence to host, process, and display it as needed to operate the Service — for example, matching your mandate against listings and showing your listing to matched tenants.
Third-party services
Your CRM is governed by your CRM's terms. We're not responsible for other companies' services.
The Service integrates with third-party services such as CRMs and authentication providers. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services, their availability, or how they handle your data.
Disclaimers
The service is provided "as is." We can't promise uninterrupted uptime, perfect data, or that any deal will close.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY MATCH, LEAD, OR INTRODUCTION WILL RESULT IN A TRANSACTION.
Limitation of liability
Our liability is capped at what you paid us in the last 12 months. We're not liable for lost deals or indirect losses.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TENANTLY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITIES, OR FAILED TRANSACTIONS, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) CA$100.
Some jurisdictions do not allow certain limitations; in those jurisdictions, these limits apply to the fullest extent permitted.
Indemnity
If your misuse of the platform gets us sued, you cover the cost.
You agree to indemnify and hold Tenantly harmless from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms, your content, your violation of law or regulatory rules, or your dealings with other users.
Termination
You can leave anytime. We can suspend accounts that break the rules.
You may close your account at any time. We may suspend or terminate accounts that violate these Terms, create risk for other users, or where required by law. On termination, your right to use the Service ends; sections that by their nature should survive (including 06, 09, and 11–15) survive. Data deletion is handled as described in our Privacy Policy.
Governing law
British Columbia law, British Columbia courts.
These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable there. You agree to the exclusive jurisdiction of the courts located in Vancouver, British Columbia for any dispute arising from these Terms or the Service.
Changes to these terms
If we change something meaningful, we'll give you notice before it applies. Keep using the service and the new terms apply.
We may update these Terms as the Service evolves. For material changes we will give at least 30 days' notice by email or in-app notice. Continued use of the Service after the effective date constitutes acceptance. If you don't agree with a change, close your account before it takes effect.
